The Mental Capacity Act in Practice

Who is it aimed at?

The course is aimed at Social Workers, Social Work Assistants and Social Care professionals in related settings (eg registered care homes etc) who wish to develop the skills necessary to undertake time-specific and decision-specific assessments.

What are the objectives?

By attending this session delegates will be supported to:

  • Understand why, when, and how to assess capacity.
  • Understand the complex issues of consent and how to proceed in an accountable, safe and appropriate manner if meaningful consent cannot be obtained.
  • Formulate an accurate question for the basis of the MCA Assessment and be able to decide if there is more than one question/assessment required.
  • Confidently assess the responses given by customers to inform a decision on whether they have capacity for that decision, including assessing fluctuating capacity.
  • Decide who is the most appropriate decision-maker for each decision to be made and ensure the response is proportionate to the decision.
  • Use a range of different communication methods which can help assist a person to make their own decisions where possible.
  • Know when and why to request the support of psychiatrists or other professionals.
  • Understand the importance of record all information appropriately and in line with the code of practice and Act

This one-day session is designed to build upon previous MCA awareness, moving beyond a basic understanding of the legislation to developing confidence in applying knowledge to practice and enhancing assessment skills under this legal framework.

How to apply:

If you work for Carmarthenshire County Council (CCC) and are logged into a CCC device – PC, laptop, tablet or smartphone, complete this application form.

If you work for the Council but do NOT have access to a CCC device or an email address your line manager will need to apply on your behalf.

Council employees cannot apply for any courses from their own personal device.


Partners, agency staff or people who do not work for the Council but meet the eligibility criteria to attend this course should complete this application form.
