1. Scope
This Policy & Procedures cover the Authority’s Chief Executive, Directors and Heads of Service including statutory officers and should be read in conjunction with the JNC Chief Officers and Chief Executives Handbooks. It is split into 3 sections each covering the rules and procedures applicable to each group.
It applies to any action occasioned by alleged misconduct which, if proved, would, according to the usual practice of the authority, be recorded on the member of staff's personal file, and includes any proposal for dismissal for any reason other than redundancy, permanent ill-health or infirmity of mind or body, but does not include failure to renew a contract of employment for a fixed term unless the authority has undertaken to renew such a contract. This includes other reasons for dismissal such as capability or some other substantial reason including a breakdown in trust & confidence between the Chief Officer and the authority. Therefore, although the definition refers to disciplinary action, it clearly requires that any action that could lead to a warning for misconduct or where there are circumstances which may result in a proposal for dismissal for any reason. It excludes dismissal on the grounds of Redundancy; Expiry of a fixed term contract; Retirement or termination on permanent ill-health grounds.
