Assessing Capacity under the Mental Capacity Act

Who is it aimed at?

Social workers and social care staff based within CTLDs, Transition Team, CRTs and CMHTs. Managers and deputies employed in both local authority and independent provider services.

What are the objectives?

The training will offer the opportunity to develop knowledge and skills in relation to assessing capacity under the Mental Capacity Act. It will specifically address the following:

  • The principles and procedures behind the assessment of capacity
  • The identification of who should assess capacity and best interests
  • Two stage test for capacity
  • Exploration of balance of probability
  • Relevant caselaw

How will it make a difference?

This will develop staff knowledge and skills and consequently enable them to provide service users with appropriate support.
