Court of Protection - Learning Lesson from Judgements
Who is it aimed at?
AMHPs and social work staff based in CMHTs and 0-25 Disability Team. Participants are expected to have a good understanding of the Mental Capacity Act.
What are the objectives?
Mental Capacity Act cases go to the Court of Protection where disagreements can’t be settled or where a case is so complex that it can’t be resolved through meetings and negotiation. Understanding the Court of Protection’s rulings can assist social workers when dealing with similar issues in their own practice. The course will offer the opportunity to:
- Consider a range of cases which have been dealt with by the Court of Protection.
- Analyse what the Court of Protection has said about a range of issues including
- best interests
- fluctuating capacity
- unwise decisions
- relevance of available resources and decision making
- how much weight to give an individual’s wishes and feelings
- life sustaining and serious medical treatmentrestricting contact with families
- Explore issues from within their own practice

It will support social workers to practice effectively in complex situations where the mental capacity of service users is an issue.
