Understanding and Implementing the Liberty Protection Safeguards
Who is it aimed at?
Team managers and Senior Practitioners from CRTs, CTLDs, CMHTs, Transition Team and Substance Misuse Team. Applications are also sought from Team Managers and ATMs based in relevant Children Services Teams.
What are the objectives?
The Mental Capacity Amendment Act 2019 replaces the Deprivation of Liberty Safeguards (DoLS) with the Liberty Protection Safeguards (LPS). LPS establishes a framework for authorising arrangements enabling care and treatment which give rise to a deprivation of liberty where the person lacks capacity to consent to the arrangements. LPS, unlike DoLS, will be applicable once a person reaches the age of 16 years. The full implementation of LPS is currently planned for April 2022.
The course will cover the following.
- What is meant by deprivation of liberty
- Identification and role of the Responsible Body
- The special arrangements for care homes
- Pre- authorisation reviews
- Role and purpose of the Approved Mental Capacity Professional, Independent Mental Capacity Advocate and the Appropriate Person
- The interface between the LPS and the Mental Health Act
- Actions needed to prepare for the transition to LPS within specific settings and specialisms
How will it make a difference?
It will give participants the opportunity to develop a greater understanding of LPS, understand how their workplace will be impacted and identify what actions are needed to manage the changes.
